BAYELSA STATE INCOME AND EXPENDITURE TRANSPARENCY

LAW, 2012

 

A LAW TO PROVIDE FOR TRANSPARENCY IN THE MANAGEMENT OF THE FINANCES IN BAYELSA STATE

BE IT ENACTED by the House of Assembly of Bayelsa State of Nigeria and by the Authority of same as follows:

PART I

Duty of the Governor to publish Income and Expenditure of the State

 

1.

(1)             In order to ensure and guarantee transparency in the management of the finances of the State, the Governor of Bayelsa State shall not later than fourteen days after the end of every month, cause to be published and delivered to the office of the commissioner in charge of information or such other officer that may be designated for that purpose by the Governor, a summary of the report of the income and expenditure of the State for the previous month.

 

(2)             The report shall specify the various sources of income and the amounts of such income.

 

(3)             i.          A copy of the report for each month shall be             forwarded to the Assembly.

 

  1. The Report shall be made available to all members of             the public upon a written application to the             Commissioner in charge of information or such other             officer that may be designated for that purpose by the             Governor, upon the payment of a fee not exceeding             N2,000 (Two Thousand Naira) only.

 

 

 

PART 2

 

Duty  of Local Government Council to publish income and Expenditure

2.

(1)             Also in order to ensure transparency in Local Government administration in the State, all Local Government councils in the State or the Chairmen thereof or any person(s) in charge of the management of the affairs of the respective Local Government Councils shall not later than fourteen days after the end of every month, cause to be published and delivered to the Auditor-General for Local Governments in Bayelsa State and the Heads of Local Government Administration (howsoever called) in the respective Local Government Councils, a summary of the report of the income and expenditure for each Local Government Council for the previous month.

 

(2)             The report shall specify the various sources of income and the amounts of such income.

 

(3)             i.          A copy of the report for each month shall be             forwarded to the Assembly.

 

  1. The Report shall be made available to all members of             the public upon a written application to the Auditor-            General for Local Government Administration             (howsoever called) for the respective Local             Government Councils upon the payment of a fee not             exceeding N1,000 (One Thousand Naira) only.

 

Offences

3.

It shall be a criminal offence for the Commissioner in charge of information or the Auditor-General for Local Governments in Bayelsa State or the Head of Local Government Administration for any Local Government Council to refuse, neglect or fail to make the said report available to an interested member of the public within 21 (Twenty one) days after the submission of the written application and the payment of the statutory fee.

 

 

4.

It shall be a criminal offence for the members of a Local Government Council or the Chairman thereof or any person in charge of the management of the affairs of a Local Government Council to fail, neglect or refuse to comply with the provisions of this Law.

 

 

5.

Any of the person mentioned in Section 3 and 4 above, found guilty of the commission of an offence in this law shall be liable to 12 months imprisonment and or an option of fine of N100,000.00 (One Hundred Thousand Naira).

 

 

 

PART 4

 

Interpretation

 

In this Law;

“Assembly” means Bayelsa State House of Assembly

 

“Chairman” means the Chairman of a Local Government Council in Bayelsa State

 

“Commissioner” means the Commissioner in charge of Information in Bayelsa State

 

“Governor” means the Governor of Bayelsa State

 

“Local Government Council” means a Local Government Council in Bayelsa State

 

“State” means Bayelsa State of Nigeria.

Short Title and Commencement

 

This Law may be cited the Bayelsa State Income and Expenditure Transparency Law, 2012 and shall come into force on the …………………………….. day of …………………….. 2012
